Generally, you can be charged with reckless driving at any time you are clocked at 20 miles per hour or more above the posted speed limit. However, many circumstances can determine the seriousness of the charge you face, such as:
- Road conditions, including rain-slick roads

- The police officer's judgment of whether you had control of your vehicle and the risks involved
